"); document.write("As an independent forensic scientist I have followed (in the media) the case of Judge Motata with great interest. I believe that the general public must appreciate that science and the courts both rely on verifiable facts, not conjecture. Therefore - if the State chooses to prosecute Judge Motata using scientific evidence, then the State must (beyond reasonable doubt) proof that the science relied upon is valid and applicable to the case at hand. Failing to do so leaves the Court with no other option but to disregard such evidence. In the end it is not about what we think or believe or feel, it is about what can be substantiated beyond reasonable doubt. Our adversarial legal system allows for the forensic evidence and the opinions of forensic experts to be tested, just a pity that as a rule only the wealthy (like Judge Motata) can afford to challenge the State's forensic evidence. That he was VERY drunk at the time of the accident was evident. That he had VERY deep pockets for the policemen who arrested him was even more evident...
