It said the issue was decided by a majority of its commissioners indicating that the Western Cape Judge President will return to his chambers on Monday.
In the executive summary of its 77 page judgment the majority of the JSC's disciplinary committee said it accepted that Judge Hlophe did speak to Judges Bess Nkabinde and Chris Jafta.
The summary goes on to say that his actions may have been unwise and imprudent but that it failed to make him guilty of gross misconduct.
However, the commissioners said they are not persuaded and a full inquiry would take matters much further as no new evidence would become available.
It also points out that both the Constitutional Court judges involved did not expressly say that he asked for them to decide the President Zuma cases in his favour.
In the minority opinion commissioners said this issue should be decided after a full cross-examination.
