Fidentia CEO J Arthur Brown may launch a court bid for three embezzlement cases against him to be turned into one, the Cape Town Regional Court heard on Thursday.

The first set of embezzlement charges relate to the investment company Fidentia, involving an investment made by the Transport, Education and Training Authority (Teta).

On these charges, Brown is out on R1-million bail.

His appearance on Thursday, before Magistrate Wilma van der Merwe, was in connection with the investment concerns Fundi and Infinity, for which he is out on R5000 bail.

Brown is presently in custody, following his arrest on the third set of embezzlement charges, this time involving the Antheru Trust.

On the Antheru Trust charges, he recently launched a protracted bail application in the Cape Town Magistrate's Court, which continues on Friday.

At Thursday's proceedings, prosecutor Thersia du Toit (CORRECT) confirmed that the trial date for the Fundi and Infinity charges, was scheduled for 10 November.

However, defence attorney Rashad Khan, told the court he wished to negotiate with the State for the consolidation of the three separate cases into one.

This would mean that one magistrate would deal with all three cases as one, instead of Brown having to appear in three different cases, before three different magistrates.

If the State elected to have three separate cases, before three different magistrates, Brown faced three separate jail sentences of 15 years each, if found guilty.

Khan said this would be unfair, and would defeat Brown's constitutional right to a speedy trial, as each of the three trials would have to take place the one after the other.

If a single magistrate convicted Brown on the combined charges, the magistrate would not only have a complete picture of everything, what but could treat all the charges as one for the purpose of sentence, Khan said.

Khan said if the prosecution insisted on three separate trials, and proceeded in November with the Fundi-Infinity case as the first, he would take the matter to the Cape High Court to compel the State to combine the three cases.

The court said the matter had to be sorted out before the start of the trial in November.

Brown was remanded to 10 November.
