"The DA received confirmation that he has been on duty and is still regarded as working at his police station even though his trial commenced today [Thursday]," said DA leader in Mpumalanga, Anthony Benadie.
"Whilst the circumstances of the murder are still being investigated, the DA recommends that Inspector Kubayi should be suspended pending the outcome of the trial," he said.
Police spokesperson Superintendent Abie Khoabane said the merits of Inspector Jimmy Kubayi's case did not warrant a suspension.
He explained that Kubayi accidentally shot the pupil while he was shooting at a fleeing suspect, the bullet hit the wall and bounced back into a classroom and hit Sedi Khoza (17).
"He had no intention of killing, he aimed for the suspect..." said Khoabane.
The incident occurred on 30 January at the Manukose High School in Merry People Stream village near Thulamahashe.
Benadie said the DA would submit questions to the MEC for safety and security to establish the reasons why the inspector was allowed to carry on with his duties.
