Cape Judge President John Hlophe's bid to stop the Judicial Service Commission's (JSC) investigation into a complaint against him will return to the High Court in Johannesburg on Monday.

Lawyers for Hlophe, who is on special leave, will try to convince the court that the JSC is biased against him and that the committee hearing his case was not properly constituted.

The JSC hearing relates to a complaint from the Constitutional Court after two judges said they felt Hlophe had made inappropriate approaches about a case dealing with President Jacob Zuma.

The JSC hearing into this complaint went ahead without him in April when he submitted a sick note.
