Clive Derby-Lewis, convicted for the murder of Chris Hani, will ask the Pretoria High Court on Tuesday to release him on parole.

The Parole Board last year recommended that Derby-Lewis be set free but this decision was put on ice to allow Hani's family to have a say in the matter.

Derby-Lewis and Janusz Walus were sentenced to death for Hani?s murder in April 1993 but these sentences were commuted to life in prison.

Derby-Lewis will make legal history when his application is heard by a full bench of judges.

The 73-year-old qualified for release after serving more than 15 years of his life sentence.
