Convicted killer Clive Derby-Lewis plans to take his struggle to be released on parole to the Supreme Court of Appeal in Bloemfontein.

The North Gauteng High Court refused to order his release last month, saying that Chris Hani's family should have a say in the matter.

Derby-Lewis and Janusz Walus were sentenced to death for Hani?s murder in April 1993 but the sentences were commuted to life in prison.

Lawyers for Derby-Lewis will hand in an affidavit at the North Gauteng High Court requesting leave to appeal last month's decision.

It is unclear when the matter will be heard but his attorney Marius Coertze said he hoped it will be before the end of the month.
