Judge John Hlophe will not have to be screened by the Judicial Service Commission if President Jacob Zuma wants to appoint him as the country's new chief justice, his supporters claim.

The comment was made as his supporters confirmed they would nominate him to a post on the Constitutional Court.

Hlophe has been accused of interfering in Constitutional Court case relating to President Zuma.

Lawyer Paul Ngobeni said he wants Hlophe to be the country's new chief justice.

He also quoted from Section 174 of the Constitution which says the President can appoint a chief justice after consulting the Judicial Service Commission (JSC) but if Ngobeni's interpretation is correct it would mean President Zuma could appoint the controversial judge to the post without him going through any public interview process.
