Western Cape Judge President John Hlophe has not made the Constitutional Court's shortlist of candidates for positions in the country's highest court.
He was accused last year of approaching some justices inappropriately in cases relating to then African National Congress leader Jacob Zuma.
The Judicial Service Commission says the seven names it will forward to the president are Johan Froneman, Chris Jafta, Sisi Khampepe, Mandisa Maya, Moegeng Moegeng, Leona Theron and Raymond Zondo.
Hlophe's name was not included which means that the final decision on the Hlophe matter is now not up to Zuma and Hlophe himself will stay in the Western Cape for now.
