The judge in the Jackie Selebi corruption trial is considering holding a trial within a trial to decide whether the defence can show a video it believes is crucial to its case.
The prosecution objected to the video being viewed in open court.
Selebi's legal team wants to show the judge a video of a meeting between state witness Glenn Agliotti, NIA official Arthur Fraser, senior policeman Mulangi Mphego and others.
The recording was made last year January when Agliotti made contradictory statements to the NIA and the Scorpions.
The prosecution does not want Judge Meyer Joffe to see the tape as it was recorded without Agliotti's permission and he had been given an assurance the meeting was off the record.
Joffe is now deciding how to proceed.
Earlier, sparks flew when Jaap Cilliers accused the state's key witness of lying while under oath.
Agliotti admitted if he did mislead the judge, he was sorry.
