Vusi Pikoli and government are both adamant the principle of prosecutorial independence has not been compromised by their decision to cut a deal.
The former National Prosecuting Authority head and government reached an out of court agreement on Saturday night, which will see Pikoli walking away with R7.5-million.
In exchange, he will withdraw his high court application challenging his dismissal. The matter was due to go to court on Monday.
Eyewitness News understands the agreement reached between Pikoli and the state includes an affirmation of prosecutorial independence.
It also contains a clause confirming Pikoli's own integrity and fitness for office but curiously this was not included in government's terse press release on Saturday night.
The Justice Department's Tladi Tladi acknowledged these commitments were included in the deal and there was nothing sinister in government's decision not to release the full agreement.
"We have, as a result, reaffirmed our commitment to the principle in the agreement we reached with Mr Pikoli and this does not really mark any departure or any change in policy," he said. The entire document is expected to be made public on Monday.
