Former National Prosecuting Authority head Vusi Pikoli is expected to withdraw his high court application challenging the decision to fire him.

This will open the door for President Jacob Zuma to appoint a new National Director of Public Prosecutions.

Pikoli and government reached an out-of-court settlement on Saturday evening, which will see the advocate walking away with R7.5-million.

After Pikoli withdraws his high court application on Monday, the position of NPA head will officially be vacant.

The new prosecutions boss will have to navigate the difficult road of prosecutorial independence.

Eyewitness News understands the deal between Pikoli and the state included an affirmation of both his own personal integrity and the independence of prosecutors but curiously this was not included in government?s media statement.

Pikoli's Lawyer Aslam Moosajee said his client has not undermined the principles he has stood for.

"We do not believe that he has compromised that [his principles]; in anyway there has been an affirmation from government about the principal of prosecutorial independence," he said.

Government said there was nothing sinister in its decision not to release the full agreement on Saturday.
