Menzi Simelane's appointment as National Prosecuting Authority head could be placed in jeopardy.

It has emerged the General Council of the Bar is investigating a complaint against him ? Eyewitness News is in possession of a copy of the document.

The complaint was forwarded to the council early this month and queries whether Simelane mislead the Ginwala Inquiry.

The bar's Patrick Mtshaulana said it was following up the complaint: "We have received something but it is in the general complaints system of the Council of the Bar."

He was at pains to emphasise the merits of the case had yet to be proven and had therefore not informed the president.

"It would be prejudging the matter to begin making an issue of it because we receive hundreds of complaints and some of those complaints are usually without merit," he said.

If wrongdoing is found, Simelane could be struck off as an advocate which could rule him out as a candidate for the position of national director of public prosecutions.
