The Jackie Selebi trial was expected to be derailed on Tuesday as the minister of State Security challenges a decision regarding former Intelligence boss Barry Gilder.

Last week the judge hearing the case ruled that Gilder must give evidence in camera but the trial was postponed for a week for minister Siyabonga Cwele to decide if he would attempt to take that decision on review.

Cwele was expected to challenge Judge Meyer Joffe's ruling that former Gilder must testify in camera.

This move could put the trial on hold for weeks if not months.

As long as this matter remains unresolved, the prosecution cannot close its case against the former commissioner.

The defence would likely then ask the judge for more time to consult with witnesses the state had not called.

The prosecution needs Gilder to take the stand to prove Selebi showed Glenn Agliotti a confidential intelligence report.
