The South African Prisoners? Organisation for Human Rights said on Monday it does not believe that fraudster Schabir Shaik is terminally ill.
In March, then Correctional Services minister Ngconde Balfour approved Shaik's release on medical grounds saying he was gravely ill.
Last week, Shaik was spotted driving his luxury 4X4 while shopping in Durban, apparently in contravention of his parole conditions.
Correctional Services Minister Nosiviwe Mapisa-Nqakula received a report on the matter and could make a decision on Tuesday.
"We are not stupid. Mr. Schabir Shaik was never in a final stage of a terminally ill disease," said SAPOHR's Golden Miles Bhudu.
