A request for leave by Cape Judge President John Hlophe has not yet been approved, the justice ministry said on Saturday.
"I'm not sure when the request was made, but I only saw it yesterday (Friday)... It hasn't been approved, we are still processing it," said ministerial spokesperson Zolile Nqayi.
He said Justice Minister Brigitte Mabandla had yet to see the request as she was out of the country.
Hlophe has been accused of trying to improperly influence the Constitutional Court's decision on search raids by Scorpions on the premises of African National Congress President Jacob Zuma.
The Judicial Services Commission met for over two hours on Friday to discuss the claims by Constitutional Court judges.
It will meet again in a month to decide whether there is a prima facie case against Hlophe.
