Lawyers for the Sonke Gender Justice advocacy group say they will prove to the equality court that African National Youth League president Julius Malema violated the Equality Act.

The court is currently hearing a complaint laid against Malema for comments he made about President Jacob Zuma's rape accuser.

He told students in Cape Town that the woman had enjoyed sex with Zuma because she stayed over and asked him for money to go home the morning after.

Sonke's attorney Chris Todd says Malema comments not only amount to hate speech but also constitute discrimination and harassment.

Todd says the group wants the young politician to pay an award to an appropriate organisation which advances women's rights.

He has also indicated a criminal case will not be opened in regards to the matter.

Malema's lawyer says his client's remarks amount to fair comment and were not offensive.

The youth league leader is not in court — only his attorney is representing him against a team of lawyers for the Sonke.
